Abstract: To promote the study of Marxs view of justice, it is necessary to reflect and solve some prerequisite questions, including the legitimacy of Marxs concept of justice. Marx excluded the old concept of justice in the sense of world view, while the development of contemporary political philosophy required Marx theory to respond positively to the question of justice.Therefore, we should go beyond the scope of the original word meaning of justice, equality and extend to rationalization of the relationship of human beings. On this basis, we should explain Marxs concept of justice as follows: “The free development of everyone is the condition of the free development of all”, which is the soul of Marxs view of justice. We should also take the standard of productivity, the critique of right, the critique of ideology, the strategy of revolution and so on as the category system of Marxs concept of justice.

摘要： 推进当前理论界的马克思正义观研究，有必要对一些前提性问题进行反思和解答，其中最为基础的是马克思正义观概念的合法性问题。马克思在世界观的意义上拒斥旧有正义概念，而当代政治哲学发展和中国特色社会主义建设实践则要求马克思主义理论对正义问题作出肯定性回应。为此，我们应当超越正义范畴之平等、公正、恰当的原始词意，而将之引申为人与人之间关系状态的合理化，并以此“正义一般”作为贯通经典马克思主义、西方思想、中国传统思想、中国特色社会主义理论体系中的各种正义学说的上位概念。在此基础上，将马克思正义观概念阐释为以“每个人的自由发展是一切人的自由发展的条件”为灵魂，以生产力标准、法权批判、意识形态批判、革命策略、过渡规划等等为复合思想维度的范畴体系。
