Striking a Balance between “Vitality” and “Regulation”: China's Independent Knowledge System on GovernmentMarket Relations

既“放得活”又“管得住”——政府与市场关系的中国自主知识体系

Abstract: The principle of “maintaining dynamic market vitality” while “ensuring effective regulation” constitutes an innovative theoretical formulation for balancing governmentmarket relations in the process of building a highstandard socialist market economy. This principle and its practices, embodying both vitality and regulation, have evolved into Chinas independent knowledge system for governing statemarket interactions within the construction and operation of a highstandard socialist market economic system. The principle of “maintaining dynamic market vitality” is primarily reflected in explorations and reforms concerning three key areas: the market entities, market access, and business environment; and “ensuring effective regulation” manifests in three pivotal domains: maintaining market order and fair competition, addressing market failures, and safeguarding against systemic risks. The essence of “maintaining dynamic market vitality” lies in cultivating an efficient market, while “ensuring effective regulation” hinges on establishing a capable government. Achieving both objectives requires new methodology and new development philosophy, in which a wellregulated efficient market and a rulesbased capable government are crucial. The socialist market economy is inherently one based on the rule of law. We must adhere to the new methodology of seeking progress while maintaining stability, be guided by the new development philosophy to drive reforms, and strengthen the legal framework through reforms. The wellregulated framework established in accordance with law serves as the scientific basis for defining the boundaries between the government and market, thereby promoting the higherlevel integration of an effective market and a proactive government. This “wellregulated framework” provides institutional guarantee for achieving both “dynamic market vitality” and “effective regulation”, ultimately realizing the dual objectives of “enlivening the market” and “ensuring orderly governance”.

摘要: 既“放得活”又“管得住”是构建高水平社会主义市场经济体制过程中处理好政府与市场关系的新表述,具有原创性和标识性。既“放得活”又“管得住”的理论和实践形成了高水平社会主义市场经济体制建设和运行中政府与市场关系的中国自主知识体系。“放得活”主要体现在市场主体、市场准入和营商环境三大方面的探索与改革;“管得住”主要体现在市场秩序与公平竞争、弥补市场失灵以及守住不发生系统性风险底线三大方面的探索与改革。“放得活”关键是有效市场,“管得住”关键是有为政府;既“放得活”又“管得住”靠的是新方法论和新发展理念,关键是有规有效市场和有规有为政府。社会主义市场经济本质上是法治经济,坚持稳中求进的新方法论,以新发展理念引领改革,以改革之力完善法治,依法“有规”是科学界定政府与市场边界的依据,从而推动有效市场和有为政府更好、更高水平的结合。 “有规”为“放得活”和“管得住”提供了坚实的制度保障,也因此实现既“放得活”又“管得好”。
