摘要： 《慈善事业法》与民商法、经济法、行政法、刑法、诉讼法等多个法律部门发生关联。从法的形式看，与《慈善事业法》相关的立法有中央层级不同效力的法律规范和地方性法规和地方政府规章。从已有的具体内容看，有的可以且应当被《慈善事业法》所吸收，有的则需要废止或加以修改。《慈善事业法》与其他相关立法的关系，涉及立法权限的划分和法律体系的统一，关乎慈善事业立法的科学性和有效实施。慈善事业立法需要重点关注并妥善处理其与民事法律、《公益事业捐赠法》、《信托法》、《行政许可法》及其他法律法规的关系,还需确立慈善服务等在立法中的合理定位。

Abstract: “Charity Law” is related to Civil and Commercial Law, Economic Law, Administrative Law, Criminal Law, Procedural Law and other legal departments From the form of law, the legislation on “Charity Law” have different effect in legal norms in central level and local regulationsAs far as the specific content is concerned, some regulations can and should be absorbed by Chinese Charity Law while others need to be repealed or modified The charity legislation need to focus on and properly deal with the civil laws, the “administrative permit law ” and other laws and regulations It also needs to establish the proper position of charity service in legislation
