新时代爱国主义教育法治保障建设的动因、经验与展望

Motivations, Experiences and Prospects for the Construction of Legal Protection for Patriotic Education in the New Era

摘要: 《中华人民共和国爱国主义教育法》的颁布是新时代爱国主义教育法治保障建设的里程碑。国家意识形态安全面临的新挑战、爱国主义教育领域出现的新问题亟需发挥法治固根本、稳预期、利长远的保障作用,运用法治思维和法治方式能有效培育爱国主义精神和规范爱国主义教育。十余年间,我国坚持党的全面领导,坚持依法治国和以德治国相结合,坚持以宪法为核心构建爱国主义教育法治体系,形成了爱国主义教育的基本范式。新时代新征程,需要继续优化爱国主义教育的规范体系,发挥多元规范的法治协同,在司法环节促进爱国主义判断标准的类型化、具象化,推动爱国主义教育法治保障建设高质量发展。

Abstract: The promulgation of the Patriotic Education Law of the Peoples Republic of China is a milestone in the construction of legal protection of patriotic education in the new era. The new challenges facing the countrys ideological security and the new problems in the field of patriotic education urgently require us to give better play to the role of rule of law in consolidating foundations, ensuring stable expectations, and delivering longterm benefits, and to adopt the ruleoflaw thinking and methods that can effectively cultivate the spirit of patriotism and standardize patriotic education. Over the past ten years, China has adhered to the Partys overall leadership, ensured the practice of the rule of law in combination with the rule of virtue, and insisted on building a legal system of patriotic education with the Constitution as the core, forming a basic paradigm of patriotic education. In the new era and new journey, it is necessary to continue to optimize the normative system of patriotic education, give full play to the coordination of multiple and standardized forms of the rule of law, promote the typology and concreteness of judgments concerning patriotism in the judicial process, and promote the highquality development of the construction of legal protection for patriotic education.
